Privacy Policy

1. Introduction

The Nevada Childhood Cancer Foundation ("NVCCF," "we," "us," or "our") is a 501(c)(3) nonprofit organization (EIN 88-0302673) that provides support services and programs to families of children diagnosed with life-threatening or critical illnesses, and to adults touched by cancer, in Southern Nevada. We respect your privacy and are committed to protecting the personal information you share with us.

This Privacy Policy describes how we collect, use, disclose, and safeguard information when you visit https://nvccf.org (the "Site"), make a donation, RSVP for an event or class, sign up to volunteer, subscribe to communications, or otherwise interact with us online. This Policy is incorporated into and forms part of our Terms of Service.

Donor information is additionally governed by our separate Donor Privacy Policy, available on the Site. In the event of a conflict between this Policy and the Donor Privacy Policy with respect to donor information, the Donor Privacy Policy controls.

2. Information We Collect

Information You Provide Directly

We collect information you voluntarily provide when you:

  • Make a donation — such as your first and last name, email address, phone number, billing information, donation amount, program designation, and any special designations, memos, or tribute/memorial information you include;
  • RSVP for events, classes, or support groups — your name and contact information and any other details requested by the applicable RSVP form;
  • Register for or apply to participate in an NVCCF program — such as your name, contact information, age or date of birth, household or family information, emergency contact information, and, where necessary for program eligibility, participation, or safety, information related to your medical condition or diagnosis, healthcare providers, medications, allergies (including food, medication, and environmental allergies), dietary restrictions, physical or mental health, treatment information, insurance information (if applicable), and other information relevant to administering the program or determining eligibility;
  • Apply or inquire about volunteering — such as your name, age, contact information, availability, volunteer interests, applicable restrictions, and information required as part of the volunteer onboarding process, which may include a volunteer application, interview, background check authorization, and training documentation;
  • Subscribe to communications — such as your email address and/or mobile phone number when you opt in to receive newsletters, event information, updates, and other communications by email or text message; and
  • Contact us — any information you include in messages, emails, phone calls, forms, or other correspondence with us.

Information Collected Automatically

When you visit the Site, we and our service providers may automatically collect certain information through cookies, pixels, log files, and similar technologies, including your IP address, browser type, device information, operating system, referring URLs, pages viewed, and the dates and times of your visits. We may use third-party analytics services to help us understand how visitors use the Site.

Information from Third Parties

We may receive information from third parties such as our payment processor (Clover), event and fundraising platforms, social media platforms when you interact with our pages, and publicly available sources.

3. How We Use Information

We use the information we collect to:

  • Process and acknowledge donations, issue receipts, and maintain donor records;
  • Register you for events, classes, support groups, and programs, and communicate about them (including confirmations, reminders, cancellations, and changes);
  • Administer and deliver our programs and services, including assessing program eligibility;
  • Coordinate volunteer opportunities;
  • Send you news, event information, and updates by email or text where you have opted in;
  • Respond to your inquiries and requests;
  • Operate, maintain, secure, and improve the Site;
  • Prevent fraud, resolve duplicate or erroneous charges, and protect the security of our systems;
  • Comply with legal, tax, accounting, and regulatory obligations applicable to charitable organizations; and
  • Fulfill any other purpose disclosed to you at the time of collection or with your consent.

4. Donations and Payment Processing

Online donations are processed through Clover, our third-party payment gateway. Payments made in person at NVCCF events may be processed using Clover Go and Clover Flex devices. Payment card information is collected and processed by Clover and is subject to Clover's privacy policy and security standards. NVCCF retains records of donation transactions (such as donor name, amount, date, and designation), generated through Clover's reporting tools and maintained in NVCCF's internal record-keeping systems, for receipting, accounting, and legal compliance purposes. These transaction records are used for internal purposes only.

5. Donor Privacy

Donor information is governed by NVCCF's Donor Privacy Policy, available on the Site. Consistent with that policy: donor information is kept confidential and is not shared, exchanged, or sold; NVCCF will not publish, loan, rent, or sell a donor's personal or business information, and will not send donor mailings on behalf of other organizations. Unless otherwise requested, NVCCF uses a donor's personal information only for the purpose for which it is submitted, such as replying to emails, processing donations and requests related to foundation events and programming, and providing updates and notices of events and important news. Donors may request that their information be added, updated, or removed from NVCCF listings by contacting info@nvccf.org or calling 702.735.8434.

Limited exceptions apply. For the safety of event attendees, NVCCF may share the first and last names of attendees who have reported food restrictions with the onsite catering or food service vendor for the applicable event. In addition, as required by law, donations of $5,000 or more for which the donor receives no direct benefit are reported on NVCCF's annual IRS Form 990.

6. Health-Related Information

Because of the nature of our mission, program participants, caregivers, and families may provide health-related information to NVCCF in connection with program applications, registration, eligibility determinations, and participation in our programs and services. Depending on the program, this information may include medical diagnoses or conditions, healthcare provider information, medications, allergies (including food, medication, and environmental allergies), dietary restrictions, treatment information, physical or mental health information relevant to participation, emergency contact information, and other health-related information necessary to determine eligibility, facilitate participation, or help ensure participant health and safety. We use health-related information only for legitimate program-related purposes, including administering our programs and services, determining eligibility, communicating with participants and caregivers as necessary, coordinating appropriate accommodations, and helping protect the health and safety of participants. We do not use health-related information for marketing purposes.

Access to health-related information is limited to authorized NVCCF staff and, when necessary, authorized volunteers, contractors, or service providers who have a legitimate business need to know the information in order to administer a program or provide related services. We maintain reasonable administrative, technical, and physical safeguards designed to protect the confidentiality and security of this information.

Although NVCCF may collect health-related information in connection with its programs and services, NVCCF is a charitable nonprofit organization and is generally not a "covered entity" subject to the Health Insurance Portability and Accountability Act of 1996 (HIPAA). Accordingly, health-related information you provide directly to NVCCF is generally not protected health information under HIPAA. Nevertheless, we recognize the sensitive nature of this information and are committed to handling it responsibly and in accordance with this Privacy Policy.

7. Children's Privacy

NVCCF serves critically ill children and their families. Information about minor program participants is generally collected from a parent or legal guardian through the application or registration process, or through referrals from our partner hospitals, clinics, or other authorized referral sources.

The Site is not directed to children under 13, and we do not knowingly collect personal information online directly from children under 13. If you believe a child under 13 has provided personal information to us through the Site without parental consent, please contact us and we will take steps to delete that information as required by the Children's Online Privacy Protection Act (COPPA) and other applicable law.

Photographs, video recordings, and stories of program participants, including minors, are used publicly only with a signed media release and consent from the participant or the participant's parent or legal guardian, as collected through NVCCF's program registration materials.

8. How We Share Information

We do not sell your personal information. We may share information in the following limited circumstances:

  • Service providers — with vendors that perform services on our behalf, such as payment processing (Clover), website hosting, maintenance, and IT support, email and SMS delivery, event management, and analytics, who are permitted to use the information only to perform those services;
  • Event vendors — for the safety of event attendees, we may share the names and reported food restrictions of attendees with the onsite catering or food service vendor for the applicable event;
  • Program partners — we may share limited information with trusted programs and community partners to coordinate participation in educational, recreational, holiday, and other support programs. We share only the minimum information necessary and, when appropriate, do so with the participant's or parent/legal guardian's knowledge or consent;
  • Legal compliance and protection — where release is required by law or regulation (for example, a subpoena) or requested by a government agency; where our records indicate possible fraudulent or deceptive activity that a governmental agency should be made aware of; or to appropriate persons where a communication suggests possible harm to others;
  • Professional advisors — with auditors, accountants, and attorneys subject to confidentiality obligations; and
  • Organizational changes — in connection with a merger, reorganization, or transfer of NVCCF's operations, subject to applicable law governing charitable assets.
  • SMS/text messaging — mobile phone numbers and SMS opt-in consent data are never shared with, sold to, or transferred to third parties or affiliates for marketing or promotional purposes; they are shared only with our SMS delivery provider as necessary to send the messages you have requested.

9. Email and Text Communications

If you opt in (for example, by checking the subscription box on our donation form or submitting the SMS consent form on our website), NVCCF may contact you via email or text message regarding news, events, donation confirmations, appointment and event reminders, and other updates. By opting in to text messages, you are providing your consent directly to the Nevada Childhood Cancer Foundation. Message frequency varies. Message and data rates may apply.

No mobile opt-in information or SMS consent data will be shared with, sold to, or transferred to any third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent are used solely by NVCCF to send the messages you have requested. Information may be shared with our SMS delivery provider only to the extent necessary to deliver messages on our behalf.

You may unsubscribe from marketing emails using the link in any message. You may opt out of text messages at any time by replying STOP to any message, or by contacting us at info@nvccf.org or 702.735.8434. For help, reply HELP to any message or contact us directly. We will continue to send transactional messages (such as donation receipts and event confirmations) as needed.

10. Cookies and Analytics

The Site uses cookies and similar technologies to enable core functionality (such as forms and event tools), improve performance (including page caching), and understand Site usage. You can manage cookies through your browser settings; disabling cookies may affect some Site features. If we use third-party analytics services, those providers may set their own cookies subject to their privacy policies. The Site does not currently respond to "Do Not Track" browser signals.

11. Data Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption of Site traffic (HTTPS). However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. Please notify us immediately at info@nvccf.org if you suspect any unauthorized access to your information.

12. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including maintaining donation and tax records as required by law, administering ongoing programs, and complying with our legal, accounting, and reporting obligations. Financial records are retained for seven (7) years, after which they are securely destroyed. When other personal information is no longer needed, we delete it or de-identify it in accordance with our retention practices.

13. Your Choices and Rights

You may:

  • Request access to, correction of, or deletion of personal information we hold about you (subject to legal record-keeping requirements);
  • Opt out of marketing emails and text messages as described above;
  • Request that your information be added, updated, or removed from NVCCF listings, as provided in the Donor Privacy Policy; and
  • Contact us with any privacy question or concern using the information below.

State Privacy Rights

Nevada law (NRS Chapter 603A) provides Nevada residents with a limited right to opt out of the sale of certain covered information. NVCCF does not sell personal information as defined under Nevada law. Nevada residents may nonetheless submit verified opt-out requests to info@nvccf.org.

Some individuals may have additional rights under the laws of other states in which they reside. To the extent any such law applies to NVCCF and no nonprofit exemption is available, we will honor verified requests as required by applicable law.

14. Third-Party Links

The Site contains links to third-party websites and services, including social media platforms (Instagram, Facebook, X/Twitter, YouTube), charity rating services (GuideStar/Candid, Charity Navigator), and calendar/event tools. This Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party sites you visit.

15. Changes to This Policy

We may update this Privacy Policy from time to time. The updated version will be posted on this page with a revised effective date. Material changes may also be communicated through the Site or by email where appropriate. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Policy.
