Terms of Service

1. Acceptance of These Terms
Welcome to the website of the Nevada Childhood Cancer Foundation ("NVCCF," "we," "us," or "our"), located at https://nvccf.org (the "Site"). These Terms of Service ("Terms") govern your access to and use of the Site, including any content, features, donation tools, event registration functions, and services made available through the Site (collectively, the "Services").
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, please do not use the Site.
2. About NVCCF
NVCCF is a nonprofit organization recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code (EIN 88-0302673). NVCCF provides social, emotional, educational, financial, and psychological support services and programs to families of children diagnosed with life-threatening or critical illnesses, as well as to adults touched by cancer, in Southern Nevada.

3. Eligibility and Use by Minors
The Site is intended for use only by individuals who are at least 18 years of age. Interactive features of the Site, including donations and event RSVPs, may be used only by individuals who are at least 18 years of age. We do not knowingly collect personal information directly from children under 13 through the Site. See our Privacy Policy for more information regarding children's privacy.
4. Permitted Use of the Site
You may use the Site only for lawful purposes consistent with NVCCF's charitable mission. You agree that you will not:
- Use the Site in any way that violates applicable federal, state, or local law or regulation;
- Make fraudulent donations, registrations, or submissions, or use a payment method you are not authorized to use;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Attempt to gain unauthorized access to the Site, the server on which the Site is hosted, or any server, computer, or database connected to the Site;
- Introduce viruses, malware, or other harmful code, or interfere with the proper functioning of the Site;
- Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our prior written permission;
- Harvest or collect personal information about other users of the Site, including program participants, donors, or volunteers; or
- Use the Site to harass, abuse, or harm another person, including any program participant or NVCCF staff member or volunteer.
5. Donations
Processing
Donations may be made through the donation form on the Site. Online donations are processed through Clover, our third-party payment gateway; payments made in person at NVCCF events may be processed using Clover Go and Clover Flex devices. Payment card information is collected and processed by Clover and is subject to Clover's terms and privacy policy in addition to these Terms.
Designations
Where the donation form permits you to designate a gift to a specific program (for example, Camp Cartwheel, Project A.R.K., Education Services, The Caring Place, or the Orion Grant Fund), NVCCF will make reasonable efforts to honor your designation. However, NVCCF retains discretion and control over all donated funds and may redirect contributions to other charitable purposes consistent with its mission where necessary or appropriate, including where a designated program is fully funded or discontinued.
Tax Deductibility
Contributions to NVCCF may be tax-deductible to the extent permitted by law. NVCCF does not provide tax, legal, or accounting advice; please consult your own advisor regarding the deductibility of any contribution. NVCCF will provide donation acknowledgments/receipts in accordance with applicable IRS requirements.
Refunds and Duplicate Charges
Donations are generally final and non-refundable. If you believe a donation was made in error, was charged in a duplicate transaction (for example, as a result of refreshing the donation page or using the back button after submitting), or was made without authorization, please contact NVCCF promptly at 702.735.8434 or info@nvccf.org. Refunds of erroneous or duplicate charges will be considered on a case-by-case basis.
6. Event Registration, RSVPs, and Classes
The Site allows users to RSVP for classes, support groups, and other events. Many classes and groups are limited to registered participants or caregivers of NVCCF programs (such as The Caring Place) and may have attendance limits, RSVP requirements, or other eligibility conditions, which are described in the applicable event listing. NVCCF reserves the right to cancel, reschedule, or modify any event, class, or group at any time, and to decline or revoke any registration in its discretion.
Certain events, programs, and activities (including, without limitation, camps, retreats, holiday assistance programs, fitness or movement classes such as yoga, and other in-person gatherings) may require participants or their parent/legal guardian, as applicable, to complete additional registration materials, including but not limited to Retreat Application Packets, Camper Applications, Teen Application Packets, and Holiday Adoptee Packets (collectively, "Program Documents"). Depending on the program, these Program Documents may include one or more of the following: liability waivers and releases of liability, medical treatment consent and authorization forms, media release and consent for photography, video recording, film, and publication, conditions of enrollment, participant agreements, and other program-specific acknowledgments or authorizations. All Program Documents are incorporated by reference into these Terms and are in addition to, and do not replace or modify, these Terms of Service. In the event of a conflict between these Terms and any Program Document, the applicable Program Document will control only with respect to the specific event, program, or activity to which it relates.
Fundraising event tickets (for example, gala or special event tickets) may be subject to additional terms, including the possibility that only a portion of the ticket price is tax-deductible. Any such terms will be stated at the point of purchase or in the donation acknowledgment.
7. Volunteering and Program Participation
Submitting a volunteer inquiry or application through the Site does not create any right to a volunteer position. Volunteer placements may be conditioned on additional requirements established by NVCCF. Individuals interested in volunteering with NVCCF may be contacted by NVCCF staff regarding available volunteer opportunities. Participation as a volunteer is subject to NVCCF's volunteer onboarding process, which may include completion of a volunteer application, an interview, a criminal background check (where applicable), and required orientation or training with the designated staff member responsible for the applicable program or event. NVCCF reserves the right, in its sole discretion, to accept, decline, or discontinue any volunteer participation. Volunteers who successfully complete the onboarding process and are selected for a volunteer opportunity will receive confirmation from NVCCF staff regarding the applicable event details, including the date, time, location, and any additional instructions or requirements. Participation in NVCCF programs and services is subject to NVCCF's program eligibility requirements and policies.
8. No Medical, Legal, or Financial Advice
Content on the Site, and content provided in NVCCF classes, groups, and programs (including wellness-oriented activities such as yoga, meditation, guided imagery, Reiki, and similar offerings), is provided for general informational and supportive purposes only. It is not medical advice, is not a substitute for professional medical care, diagnosis, or treatment, and is not intended to treat or cure any illness. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition, and never disregard professional medical advice or delay seeking it because of something you read on the Site or experienced in an NVCCF program. Similarly, nothing on the Site constitutes legal, tax, or financial advice.
9. Communications, Consent, and SMS Terms
By providing your email address and opting in, you agree that NVCCF may contact you via email regarding news, events, and updates. You may opt out of marketing emails at any time by following the unsubscribe instructions in the message.
SMS/Text Messaging Terms
By providing your mobile phone number and opting in to text messages (for example, through the subscription box on our donation form or the SMS consent form on our website), you consent to receive text messages from the Nevada Childhood Cancer Foundation, including news, event information, donation confirmations, reminders, and other updates. Consent is not a condition of making a donation or receiving services.

- You may opt out at any time by replying STOP to any message. After you reply STOP, you will receive a final message confirming your opt-out, and no further messages will be sent.

- Carriers are not liable for delayed or undelivered messages.
Your mobile phone number and SMS opt-in data will not be shared with third parties or affiliates for marketing or promotional purposes, as described in our Privacy Policy. Opting out of marketing communications does not affect transactional communications, such as donation receipts or event confirmations.
10. Intellectual Property
The Site and its contents — including text, graphics, logos, images, photographs, program names (such as Camp Cartwheel, Project A.R.K., The Caring Place, and the Orion Grant Fund), audio, video, and software — are owned by or licensed to NVCCF and are protected by copyright, trademark, and other intellectual property laws. You may view, download, and print materials from the Site for your personal, non-commercial use only, provided you retain all copyright and other proprietary notices. Any other use, including reproduction, modification, distribution, republication, or public display of Site content, requires NVCCF's prior written permission.
11. User Submissions
If you submit content to NVCCF through the Site (for example, messages, stories, testimonials, photographs, or memorial designations), you represent that you have the right to submit that content and you grant NVCCF a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with its charitable mission, subject to our Privacy Policy. Do not submit confidential medical information through general-purpose forms on the Site.
12. Third-Party Websites and Services
The Site contains links to third-party websites and services, including social media platforms, charity rating services (such as GuideStar/Candid and Charity Navigator), and event or calendar tools. These links are provided for convenience only. NVCCF does not control and is not responsible for the content, policies, or practices of any third-party site or service, and a link does not imply endorsement. Your use of third-party sites and services is at your own risk and subject to their terms and privacy policies.
13. Disclaimer of Warranties
THE SITE AND ALL CONTENT AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. NVCCF DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NVCCF AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF NVCCF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, NVCCF'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
15. Indemnification
You agree to indemnify, defend, and hold harmless NVCCF and its directors, officers, employees, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.
16. Privacy
Your use of the Site is also governed by our Privacy Policy, available on the Site, and, with respect to donor information, by our Donor Privacy Policy. By using the Site, you acknowledge that you have reviewed those policies.
17. Termination
NVCCF may suspend or terminate your access to the Site at any time, with or without notice, for any conduct that NVCCF believes violates these Terms or is otherwise harmful to NVCCF, its mission, or other users. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
18. Governing Law and Venue
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts.
19. Changes to These Terms
NVCCF may revise these Terms from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
20. Miscellaneous
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect. NVCCF's failure to enforce any provision is not a waiver of its right to do so later. These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and NVCCF regarding your use of the Site. You may not assign these Terms; NVCCF may assign them in connection with a reorganization or transfer of its operations.
